Subclass 482 work visa pathway to subclass 186 and subclass 187 permanent resident visas
An Australian work visa can be granted for up to 2 years or for up to 4 years depending on the occupation list that applies. The employer’s business or company must be an approved sponsor to be able to nominate a person to fill a job vacancy on a work visa.
The subclass 482 work visa is a pathway to the employer nominated subclass 186 permanent resident visa where you hold a 4-year work visa. You need to have worked for your employer for 3 years with the subclass 482 visa. Similarly, it is a pathway to the regional employer nominated subclass 187 permanent resident visa.
It is possible to apply directly for the subclass 186 visa where you pass the skills assessment and an employer nominates you to work for them.
As a general rule, the employer must demonstrate that the job is a genuine position in the business. Further, you must advertise to recruit an Australian locally and prepare a labour market testing report.
There are various exemptions and waivers to this for citizens and businesses from certain countries. For example, there are exemptions for executives and senior managers that arise under the World Trade Organisation (WTO) and the General Agreement on Trade in Services (GATS) that apply to citizens and businesses of member nations.
Wider exemptions apply to all occupations generally as a result of various international free trade and economic agreements with:

- the Trans-Pacific Partnership nations
- GATS nations
- the A.S.E.A.N.
- New Zealand
